Eagle Industries Files Charges Against UNITE HERE for Harassment of Workers

Eagle Industries today announced that they have filed an unfair labor practice charge with the National Labor Relations Board (NLRB) against UNITE HERE after Eagle New Bedford employees informed management that they were being harassed by union representatives at their homes, during their breaks or on their way home from work.
Eagle management had previously been notified by employees over several weeks' time that they felt increasingly threatened and intimidated by UNITE HERE representatives. For the last two months, union organizers reported actions have included photographing employees at a close distance as they leave work, going to the homes of employees during evening hours and
several union representatives encircling an employee on his walk home after work.
Eagle has asked the NLRB to investigate this conduct and, if the NLRB finds merit in the employees' complaints, to put a stop to it as soon as possible.
"While we are legally prohibited from stating how UNITE HERE's drive is affecting our ability to do business in New Bedford, we do have the right to protect our employees from harassment on our property.
We have filed charges against UNITE HERE in hopes that the union will stop threatening and harassing our employees," said Eagle Industries Vice President Scott Carver. "We regret that this action is necessary, but our employees deserve to make their own membership choices without the fear of union harassment."
Notably, the National Labor Relations Act specifically disallows union representatives from threatening, coercing or intimidating employees who opt not to support the union or who decline to sign a card asking for a vote on unionization. Companies are expressly permitted to file charges against a union if they believe the union has violated the no-harassment provisions of the National Labor Relations Act.
